Construction Disputes and Mediation: Common Causes, Resolutions and Case Studies

Overview

Construction disputes are common. Aggressive bidding, vague tender scopes, unrealistic deadlines, and flawless-finish demands lead to overruns, delays, and blame shifting among owners, contractors, and consultants.

Because the sector can contribute about 20 percent of a nation’s GDP, effective dispute resolution is essential. Litigation and arbitration remain prevalent, yet they are formal, adversarial, slow, and costly, and projects stall while legal teams scrutinise contracts and experts argue over details.

Mediation offers a faster, cheaper, and more collaborative route. It brings parties together early, encourages joint problem solving, preserves commercial relationships, and allows work to resume with minimal disruption.
