A Comprehensive Course on Construction Contracts and How to Negotiate, Administer, and Manage Them

Overview

Construction Projects are complex undertakings from the point of procurement, to contracting, execution and managing the works and often avoiding conflicts and resolving disputes that may arise. An understanding of the intricacies (often far more common sense than legalistic) of contracting can go a long way to appreciating how best to negotiate, administer, and manage such projects.

Objective

• Understanding Contractual Terms - The session considers contract in general, language, formation, principal elements, relationship/requirements, tendering process, key terms and clauses, key provisions, types, interpretation, performance, unenforceability, breach, remedies with contracts.

• Procurement, Intent, Award, Model and Standard Forms - The session considers strategies, methods, and international procurement; purpose, circumstances, legal effect of Intent/Award; types/models of construction contracts, types, use, elements, essential clauses and amending standard form contracts.

• Negotiating and Collaborating - The session considers general, style, guidelines, skills involved with Negotiating the whole construction process and ultimately adopting a Collaborative approach in all aspects of construction contracts.

• Managing Disputes – The session considers the consensual and adjudicative dispute resolution regimes including conciliation, mediation, neutral evaluation, expert determination, dispute boards, adjudication, arbitration and litigation

Course Outcome
