Managing Contractual Risks: From Contract Clauses to Contractor's All Risks(C.A.R.)Policy Activation

Course Introduction

In the complex landscape of Singapore’s construction industry, the gap between contract obligations and insurance coverage can lead to significant financial exposure. This intensive 6-hour masterclass bridges that gap.

Presented by two industry veterans with engineering backgrounds, the session provides a dual perspective:

  1. Contractual Compliance: Understanding how PSSCOC, SIA, and FIDIC forms dictate insurance requirements.
  2. Insurance Execution: How to structure a C.A.R. policy that responds when a loss occurs.

By combining legal frameworks with underwriting reality, this course equips Project Directors and Managers with the tools to safeguard their projects against unforeseen liabilities.

Learning outcomes:

Upon completion of this program, participants will be able to:

  • Deconstruct complex insurance clauses within standard forms of contract (SIA, PSSCOC, FIDIC).
  • Identify common pitfalls and "silent risks" in contract wordings that lead to insurance gaps.
  • Navigate the specifics of C.A.R. policy endorsements and exclusions.
  • Execute the correct protocol for triggering a claim to ensure maximum recovery.
  • Implement proactive risk management strategies to lower project premiums and disputes.

Programme outline:

  • Session 1: The Contractual Foundation (3 Hours)

  • Comparative Analysis: Review of insurance obligations under SIA, FIDIC, and PSSCOC.
  • Indemnities & Liabilities: Understanding the contractor’s duty to protect the Project Owner.
  • Drafting Pitfalls: Identifying ambiguous wordings that create "uninsurable" obligations.
  • Q&A: Specific contractual challenges faced by Singapore contractors.

Session 2: The Insurance Response (3 Hours)

The Anatomy of C.A.R.: Understanding Section I (Material Damage) and Section II (Third-Party Liability). Key Endorsements: What "add-ons" are essential for Singapore urban construction? Claims Triggering: A step-by-step guide on what to do when loss occurs on-site. Case Studies: Real-world examples of  insurance claims and technical disputes.
